What bothers me is that so many people see a crypto rise and so they cash out. When too many people do this, said crypto suffers and there are very limited rewards. Take XRP for example. In the last few days, it has been steadily climbing. But if you look at the hourly or daily charts, you can see where a lot of people pulled out their profits, creating a vulnerable market. I just hope and pray that more people buy into this soon to be bear market than people pulling out.

The SEC lawsuit won't matter. All the SEC or Commerce would have to do is declare that XRP is controlled by foreign governments and needs to be outlawed. If this bill passes, and the President confirmed the SEC's findings about foreign influence, ownership of ANY crypto, including XRP, would be outlawed. Any attempt by you or any other American citizen to access their crypto holdings would be subject to fines and 20 years in jail.

I don't understand why buy back keeps coming up. XRP is divisible to 7 decimals was it? not to mention just under $XRP 50B in escrow to be made available as market demand grows. The price can appreciate strongly and Ripple dole it out at a reasonable rate that keeps market friction down while maintaining a stable and strong price.

Your first paragraph is correct. Numerous real lawyers have said that *early* Ripple sales of XRP probably passes the Howey test (for what is and isn’t a security). But at some point, other players on the XRPL have diminished the “common enterprise” argument to where Ripple’s sales of XRP are not a security.

And that was the problem with the SEC’s case. They tried to say that XRP itself is a security, and any sales of it - even between two non-Ripple people (e.g. a hypothetical sale between you and I) was an unregistered sale of a security of Ripple, the Company.

That is a significant overreach, unsupported by the law. If that argument were to hold, nothing would stop the SEC from exercising jurisdiction over every single token sale, regardless of who it was between. No way adoption occurs in the US under such a construct.

Your second paragraph is irrelevant to the case. Holding a bunch of something is just owning a lot of property. You might not like it, but it’s irrelevant in a Howey analysis (at least today).

Whatever I dislike about the complete ineptitude of the SEC regarding how they slept at the wheel with providing any sort of guidance about cryptocurrencies. Ripple and their founders sold what was at the time unregistered securities. Pre-minting billions of tokens and selling them to people is the definition of unregistered securities.
Not to mention all the escrowed XRP tokens that Ripple owns and sells on the market every month. Talk about giving yourself free money at the expense of your loyal followers.

I’m afraid of letting the intrusive thoughts win. They are telling me to self half my XRP and wait for it to tank and buy back at 35/40 c. In paper sounds great, but if it is not bs and it actually ends, it could be devastating

In what way? This whole thing has been a ruse to delay the inevitable. Do you really think anyone wants to actually destroy the future financial system and the economy with it? No, man, this has all been BS and Ripple will hands down win this case. ISO20022 is mostly useless without XRP and we’re almost ready to flip the switch. She’s gonna rule soon and we’ll be off to the races, probably. We’re ready, the world is ready, and you can bank on her being ready too.

Yes. Signet and SEN as well that are now gone because of the Fed. They all operate in the same medium to large scale transaction space. Paypal and the likes work mostly for retail customers. XRP can handle the whole range from retail to corporate. I believe the SEC's rhetoric that XRP has no usecase seems to suggest that it doesn't work for retail like Paypal does, which ofc is not true.

FedNow is a domestic system. It only operates in the US, 24 hour interbank transfer systems like the one Signature Bank had running are a direct competitor and a threat but XRP's primary use case is cross-border reconciliation.
They also would have had to "tamper" with Judge Torres a few months ago. Her response to the Daubert motions are written with the final ruling on summary judgment in mind. They're often released together and even when they're not, she has probably had the SJ in hand this whole time. She's giving them one last chance to reach a settlement. If she were to change it at the last minute because of outside influence it would be inconsistent with what she deemed relevant in Daubert and it would show.

That ATH was an anomaly that lasted a few days. It's not meaningful in any way. There was also a lot less XRP in circulation at that time.
