# Malikie sues OPPO again!
2026-07-29 18:34 Source: Intellectual Property Finance
Recently, patent operating entity Malikie Innovations Limited has filed a lawsuit against OPPO and its sub-brands Realme and OnePlus, as well as OPPO's European distributors, regarding patent EP3843496.
**Translation by: Xia Yuxin, Intellectual Property Finance**
According to information obtained from the official website of the European Patent Unified Court (UPC), Malikie Innovations Limited, the patent operating entity, has recently filed a lawsuit against OPPO and its sub-brands Realme and OnePlus, as well as OPPO's European distributors, regarding patent number EP3843496.
The UPC Mannheim Regional Court updated its case information on July 27, 2026, showing that the lawsuit was formally accepted on July 9. Previously, Malikie filed a lawsuit against OPPO at the UPC Mannheim Regional Court on February 2, 2026, involving patent EP2387862B1; on March 4 of the same year, he filed an additional lawsuit at the UPC Munich Regional Court. The patents involved in the previous two cases are the same as those in Malikie's lawsuit against Xiaomi in November 2025, namely EP2387862 and EP3797535.
According to Intellectual Property Finance, Malikie was founded in 2023 and is the patent operating entity of the Irish company Key Patent Innovations. In May 2023, the company acquired 32,000 patents from BlackBerry for $200 million, covering technologies such as wireless communication and information transmission; in January 2024, it obtained exclusive licensing rights to more than 2,000 of BlackBerry's cellular standard essential patents (SEPs).
Malikie has been negotiating with Xiaomi and OPPO since 2023, but progress has been slow. On March 2, 2026, Xiaomi filed a lawsuit against Malikie in the Shenzhen Intermediate People's Court to determine FRAND rates, requesting confirmation that Malikie is obligated to grant licenses under FRAND terms and should negotiate in good faith, while also determining FRAND rates for 3G, 4G and 5G SEPs within China.
Intellectual Property Finance will continue to follow up on further developments.
**Case Background**
In July 2025, Malikie sued Xiaomi in the Munich Regional Court in Germany and the Delhi High Court in India.
  • In November 2025, Malikie filed an additional lawsuit against Xiaomi at the Munich branch of the Unified Patent Court (UPC).
On February 2, 2026, Malikie filed the first lawsuit against OPPO in the UPC Mannheim District Court.
On March 2, 2026, Xiaomi filed a lawsuit against Malikie in the Shenzhen Intermediate People's Court to determine FRAND rates.
On March 4, 2026, Malikie filed a second lawsuit against OPPO in the UPC Munich branch.
On April 30, 2026, the Delhi High Court of India ruled in the Malikie v. Xiaomi SEP dispute, requiring Xiaomi to provide provisional security.
On July 9, 2026, Malikie filed a third patent infringement lawsuit against OPPO and its sub-brands Realme and OnePlus, as well as OPPO's European distributors, at the UPC Mannheim Regional Court.
