What exactly are you going to do that's different than the 6 or 7 times I've already called over the past three months? The ticket is already assigned to the QDRO group. I want to speak to someone in that group directly. I want to speak to a supervisor in the QDRO group to know why Fidelity has stolen tens of thousands of dollars from me.

You can, but you are not required to. So long as it remains in the employer 401k it enjoys a special QDRO status: penalty free withdrawals before 59.5.
If you roll it to an IRA in your name it loses that 10% penalty exemption, and normal IRA rules apply.

I’m sorry you’re going through this. I just wrapped up my divorce in December and definitely it was a 0/5 stars experience. I feel for you as I know there can be a lot of emotions involved.
Anyway, standard disclaimer here: my experience is in another state than FL so you’ll want to get anything you get from this thread through your own legal counsel.
I’m assuming since you didn’t mention it you don’t have any cash or taxable savings to split. That’s the easiest way to buy out a portion on a home and leave some liquid for you.
The most tax and fee/interest efficient way to buy you out for all parties will be the QDRO. That will just transfer money, as appropriate, between the different tax advantaged accounts y’all have. Once the money is in your tax advantaged accounts then all the standard rules, and penalties, apply to these accounts. Nothing changes there.
So even though the QDRO is most tax/fee efficient it does nothing (or little, depending on your age) for liquidity.
I’ll leave others to comment on the liquidity and pros and cons of the HELOC vs cash out refi but I’ll add: some other options are for y’all to sell the house and split the proceeds (since you are considering loan options for your liquidity this would allow both of you to get purchase rates vs HELOC and cash out refi rates so maybe be more optimal). And the other is to consider non asset or cash transfers of property. Such as any agreements on APL / alimony or transfer of things like cars, etc.
