Decent lottery ticket IMO. The short-term setup actually has some merit since the stock is trading near cash value, and EDTX is famously friendly to trolls. Catching a short-term pop off a big jury verdict this fall is plausible, so playing the momentum isn't nuts.
But the long-term thesis is a pipe dream. Databricks has some defenses that could take damages to zero, and even if they get a massive jury award, CAFC routinely tosses out these older software patents or at least reject the fuzzy math needed to hit huge damage numbers.
Basically, the lawsuit is real, but the billion-dollar revenge campaign isn't. If you get a nice bump this fall, take the money before a multi-year appeal drains the clock. Better than Powerball tickets tho. Honestly, might buy some OTM calls
Bet only what you can afford to lose, not investment or legal advice, be smart, stay safe, get money etc. etc.

Even if they win, appeals and SCOTUS could take a very long time.
I don't think they will win due to bullet 1 below.
# Critical Legal & Financial Counterweights
1. **The Apache Open-Source / Implied License Defense** Databricks’ primary escape hatch is arguing that Yahoo’s original contribution of MapReduce/Hadoop technology to the open-source community created an implied license, patent exhaustion, or equitable estoppel. If accepted by the court, the damages baseline drops to zero.
2. **Apportionment Rigor (35 U.S.C. § 284)** Federal law requires damages to be strictly apportioned to the specific incremental value of the patented key-value grouping enhancement, rather than Databricks’ entire platform revenue. Generating a $100M+ verdict requires expert economic models surviving rigorous *Daubert* challenges.
3. **Section 101 & Appeal Discounting** Non-practicing entity (NPE) trial wins in EDTX carry high historical appeal risk at the Federal Circuit, where § 101 ("abstract idea") challenges or damages reductions frequently trim initial jury awards.
