The lawsuit between CAPR and Nippon Shinyaku, over their distribution agreement for Deramiocel in the US market. I’ll try to be concise. There was an
issue with the pricing arrangement in their agreement. Essentially, the error made it to where people with Medicare/Medicaid wouldn’t get reimbursement from the drug. The CEO for NS acknowledged that there was a flaw in agreement regarding pricing, but neither side could come to an agreement for an amendment. CAPR also accused NS of failing to develop a viable commercial launch for the drug. Last year, when the FDA rejected Deramiocel (based off phase 2 data), NS went “pencils down” on planning any commercial launch until late this year, to the point there was going to be a delay distributing Dermiocel in the US if they get FDA approval in August.
I’m biased, but overall the case seems to favor CAPR. Best case scenario, if CAPR is rescinded from the agreement, and they get full distribution right for the US market, then the share price will explode imo

CAPR - if there lawsuit with NS is ruled in their favor, then this will bounce back to the $30’s at least. They have an upcoming PDUFA on August 22nd. Their phase 3 data looks fantastic, hurting both the primary and secondary end point. I think this will be trading $50+ if they get FDA approval
