Yes, I think that part is undisputed. If your prover is not fit to handle the load it should not be proving. At the moment the network also seems to be relatively forgiving when one misses a full proof here or there. This keeps many more provers alive than should be. Some changes are coming to fix this. In a few weeks many of these provers will become unprofitable.
I like the framing as a DOS attack (denial of service attack) on the provers, but I am honestly not sure if they use any specially designed operations or just spam 'normal' transactions for slower provers to miss the proving window. In contrast to the Shanghai, attacks normal Aztec users should not see any difference at all. Blocks get proposed and proven normally. One could even have the very valid point of view that this actor just fixes the design flaws of the prover rewards to make the provers more competitive. The actor obviously does it to get more rewards in their own pocket, but as long as the prover ecosystem gets more efficient it nevertheless will improve the resilience of the network.

I definitely do not know that. From how this prover submits proofs people assume that they at least run modified software, but I think one cannot say anything about how they create the proofs. I do not really understand the details of running a prover, but as far as I know it all runs only on CPUs at the moment. No GPUs involved anywhere. From this alone it is clear that there is a large space of possible improvements for proving on Aztec. Maybe this one actor just slightly improved one part of the proving pipeline and is now ahead of the crowd because of that.
