Correct me if I am wrong but its only certain departments that treat it as a commodity or asset in the USA like the IRS,Treasury, and CFTC.
Bitcoin is treated as Money by FinCEN and by the courts as we learned in Trendon Shavers (Bitcoin Savings & Trust)(and this created legal precedent that Bitcoin was not a "Security" either) .
The judge ruled that:
>“Bitcoin is a currency or form of money, and investors wishing to invest in BTCST provided an investment of money.”
Bitcoin qualifies as “money” for purposes of securities law(not “legal tender” in the US though)
Also at the state level Bitcoin is also treated as money with Money Transmitter Licenses (MSLs / MTLs)
So in the US its a mixed bag where its sometimes consider money and other times an Asset/Commodity
